The Fourth District Wisconsin Court of Appeals has ruled against a legal challenge filed by a driver who hit and killed a bicycle rider in Madison five years ago.
Brian Hodgson was fighting a $5.5-million judgment against him.
He argued the judge improperly allowed a doctor’s testimony in the case and he also argued that the bike rider, 23-year-old Emilly Zhu, had caused the accident. She was crossing a street on Madison’s west side when Hodgson hit her in June 2015.
The court ruled that judges have broad discretion in allowing expert testimony and that Hodgson failed to show negligence by Zhu.
