A Dane County judge has ruled a state constitutional amendment approved by voters last April was improperly enacted.
Judge Frank Remington issued his ruling Tuesday, saying the question presented to voters was misleading.
Marsy’s Law was designed to protect victims’ rights.
The judge says it should be rescinded, but – as part of his ruling – he has allowed it to remain in effect pending an appeal.
Judge Remington says Wisconsin voters should have been asked two questions instead of one, so they were aware the measure increased the right of victims but also diminished the rights of those accused of crimes.
