The Wisconsin Supreme Court will stay on the sidelines while the fate of Governor Tony Evers’ emergency order limiting the size of public indoor gatherings is hashed out.
The Supreme Court refused to consider the case Wednesday, offering no explanation.
The order was issued in early October and it is set to expire Friday.
The 3rd District Court of Appeals blocked the order October 23rd while it considers the arguments.
The decision not to take the case from the appellate court came on a four-to-three vote of the justices.
