The Wisconsin Court of Appeals is citing an error by a lower court judge for its order that a man convicted of poisoning his wife should get a new trial.
That judge reinstated Mark Jensen’s conviction two years ago.
Jensen’s conviction was based in a large part on a letter and voice mail messages Julie Jensen left before she died. She said her husband should be the first suspect if anything ever happened to her.
The courts decided the letter violated Mark Jensen’s constitutional rights and the ruling was issued Wednesday.
No new trial date has been set.
