A jury will decide the fate of Timothy Hauschultz after his defense team tried to get all counts against him dismissed.
That’s what happened after the state rested during the 6th day of the trial. District Attorney Jacalyn LaBre called two more witnesses.
One was former Manitowoc County Sheriff’s Office Detective Christine Bessler, who testified to interviewing Ethan Hauschultz’s cousin Damian.
Bessler also said under oath that Damian said it was Tim who picked the size of the log that Ethan and his twin brother were to carry.
Defense Attorney Donna Kuchler showed clips from the interview with Damian to show that Timothy was trying to take care of Ethan before he passed away at the hospital.
The defense then tried to get Timothy’s case dismissed through a directed verdict. Kuchler argued that the evidence only showed that Damian killed Ethan.
DA LaBre argued that Timothy’s actions of making Ethan and his brother carry wood was a form of child abuse and was a danger to the children’s lives.
While Calumet County Judge Carey Reed said he was troubled by how the state presented evidence, it did not warrant the charges and dismissed the defense’s motion.
Closing arguments are set for tomorrow.
Timothy faces six charges, including neglecting a child; the consequence is death after Ethan’s 2018 death.
