
A Sheboygan County Judge has resentenced the man charged with the death of Ethan Hauschultz.
Judge Samantha Bastil kept a 20-year prison sentence in place for 22-year-old Damian Hauscultz.
But she lengthened Damian’s extended supervision from 10 to 15 years.
Damain has already served around six years after he was found guilty due to a no-contest plea in Ethan’s death back in 2021.
During the hearing, Ethan’s mother, Andrea Everett, asked Judge Bastil not to shorten Damian’s sentencing, citing continued emotional trauma for her family.
She also spoke to Damian, asking him to contact District Attorney Jacalyn LaBre to reargue the seriousness of the case, calling the crime unimaginable.
Ethan was poked and hit close to 100 times while carrying a heavy log for not knowing Bible verses as a punishment.
Ethan was later buried in the snow and died at a hospital from hypothermia.
She also mentioned Damian’s character, saying he asserted the violence against Ethan when he didn’t have to.
Damian’s attorney, Karin Jonch Clausen, said that the 22-year-old was himself abused by his great-uncle, Timothy Hauschultz, and that he’s making better decisions now that he’s grown up.
Both LaBre and Jonch Clausen also spoke to a psychological evaluation done on Damian.
The district attorney was concerned that the doctor who did the evaluation only focused on the criminal complaint and not other evidence found by investigators.
Damian spoke during the resentencing saying he feels deep regret for what happened to Ethan and wishes he had treated the 7-year-old better.
Judge Bastil said that while Damian was only 14 at the time of the incident, she couldn’t ignore the seriousness of the crime.
