
The man convicted in the death of Ethan Hauschultz in 2017 will be resentenced today (June 19th).
22-year-old Damian Hauschultz was initially sentenced in 2021 to 20 years in prison after being found guilty due to a no-contest plea for Ethan’s death.
Resentencing by Sheboygan County Judge Samantha Bastil comes as Damian could be a key witness in the trial of his great-uncle, Timothy Hauschultz.
He was also granted resentencing after Judge Jerilyn Dietz had to recuse herself from his case since she was a Guardian ad Litem for him in a separate case.
Dietz was the judge who sentenced the 22-year-old when he would have been only 18.
Timothy’s case is scheduled to return to court in September for a pretrial motion. His case could not go to trial because Damian took his conviction to the Court of Appeals and the Wisconsin Supreme Court.
The 55-year-old is charged with neglecting a child, causing death, contributing to delinquency, and three counts of child abuse.
Prosecutors say Timothy ordered Ethan Hauschultz to carry a heavy log outside for not knowing Bible verses.
Damian would hit and poke the 7-year-old over 100 times before he was buried in the snow, and would die at a hospital.
