
The De Pere teen convicted in a 2021 attack on the East River Trail was back in court.
The case of Miles Cruz went before the Wisconsin Supreme Court, which decided not to hear his appeal.
A lower court had ruled that Cruz’s rights were not violated during the collection of DNA evidence without a warrant.
Cruz was 17 at the time of the incident, in which a woman was attacked while walking on the East River Trail with her infant child.
The four-week-old child was found lying alone in the grass by the victim’s husband, and the woman was found in the tall grass near the trail.
Cruz was ordered to spend 42 and a half years in prison in 2023 and has repeatedly appealed his conviction.
