Prosecutors have responded to requests made for the man charged in the death of 3-year-old Elijah Vue.
Previously, attorneys for 40-year-old Jesse Vang asked to have evidence of cadaver dogs not be used and to have a change of venue, or to have a future trial moved out of the county.
Court documents show that Manitowoc County District Attorney Jacalyn LaBre explained that the cadaver-dog evidence would not be used at trial, but that moving the trial out of the county is not necessary.
She stated that based on federal and state cases, “the defendant has not met the high bar to warrant a change in venue. This court can ensure a fair and impartial jury through its voir dire before resorting to the drastic remedy of ordering a change of venue and sequestration of jurors.”
Vang’s case is scheduled to return to court on May 18th for a motion hearing.
He’s been charged with physical assault of a child, the consequence is death, hiding a corpse, revisiting or obstructing an officer, and chronic neglect of a child.
Elijah’s mother, 32-year-old Katrina Baur, is also facing charges in her son’s death after she allegedly dropped off the toddler to Vang for “disciplinary purposes” and to help “make him a man.”
Elijah was first reported missing in February 2024 from Vang’s apartment in Two Rivers.
His remains were then found in the Town of Two Rivers in September.
