
The attorney for the man charged with Ethan Hauschultz’s death is now looking to change his resentencing date.
In a new motion filed by Attorney Karin Jonch-Clausen, she asks Sheboygan County Judge Samantha Bastil to adjourn 22-year-old Damian Hauschultz’s upcoming resentencing hearing in April because she wants a new evaluation for her client to “provide a reliable and current assessment of risk and rehabilitative needs.”
Jonch-Clausen says the earliest evaluation update might not be until June of this year.
This comes after Damian asked to be resentenced in his case, following Judge Jerilyn Dietz’s recusal from both his and his great-uncle Timothy’s cases due to her time as a Guardian ad Litem in a separate case.
Damian has previously been sentenced to 20 years in prison for Ethan’s death after the then 7-year-old was punished by carrying a heavy log for not knowing Bible verses.
A criminal complaint says that Damian, who was a teen at the time, hit, poked, and struck Ethan 100 times before his body was buried in the snow.
Ethan later died after being taken to a hospital. Timothy is facing charges of neglecting a child, the consequence is death, three counts of child abuse, and intentionally contributing to delinquency.
Prosecutors will file a written response to outstanding motions in April and will have a motion hearing in his case on May 20th.
They say Timothy asked Damian to make sure the punishment is carried out on Ethan.
His trial is set for October 12th.
He was unable to start trial proceedings previously because Damian’s case had to go through the appeals process, and the 22-year-old could be a witness in Timothy’s case.
