
The great-uncle charged in the death of Ethan Hauschultz won’t return to court until a hearing happens in another case.
55-year-old Timothy Hauschultz returned to court yesterday (January 28th) for a status conference after his trial was postponed due to Damian Hauschultz wanting to be resentenced or get a new trial.
Damian was going to be one of the main witnesses to testify during Timothy’s trial. However, his newest attorney has filed the previously mentioned motions after a Manitowoc County judge was found to be a Guardian ad Litem for the 22-year-old in a previous case.
The judge has since recused herself from both Timothy’s and Damian’s cases. Damian will return to court on March 3rd for a status conference in front of Sheboygan County Judge Samantha Bastil.
During Timothy’s hearing, Calumet County Judge Carey Reed set the 55-year-old’s next court date for March 18th and denied a motion by the defense to remove a GPS monitoring system.
District Attorney Jacalyn LaBre states that they asked for the GPS so Timothy could get his cash bail reduced, to which Reed agreed.
Timothy is facing charges, including neglecting a child, the consequence is death, three counts of child abuse, intentionally causing harm, and intentionally contributing to a death.
Ethan died in a hospital after he was forced to carry a heavy log around for not knowing Bible verses.
Damian was convicted of hitting and poking the 7-year-old before he was buried in the snow.
