
A federal judge has dismissed a wrongful death case against an Appleton Police officer.
WBAY reports that 33-year-old Jay Steinke shot 33-year-old Jimmie Sanders at a bar in May 2017 while responding to a report of shots fired inside.
Sanders would later die from his injuries.
An investigation showed that Steinke was pushed by people running out of the bar and had to use force to stop an immediate threat.
The officer would also shoot suspect Henry Nellum, who was convicted of starting the altercation at the bar.
Sander’s estate would file a federal wrongful death lawsuit in 2020, claiming the officer did not hear gunshots at the bar, didn’t have a description of the gunman, and did not announce his presence or commands when he entered.
A federal judge ruled yesterday (September 30th) that there was no precedent of law in the case that would show Steinke violated the constitutional rights of Sanders.
Nellum would later be convicted in the bar incident and would be sentenced to 16.5 years in prison.
