An attempted homicide case in Manitowoc remains open, over two years after the incident.
David J. Downs was supposed to be going on trial this month, however, on August 14th, just shy of a month ahead of his jury trial, Downs requested that his attorney withdraw from the case.
The reason for the request was not specifically noted, but Defense Attorney Joseph Ohiku was noted on CCAP as telling Judge Mark Rohrer that he is “preparing for the trial” and “not ignoring his client.”
The request was granted, leading to the cancellation of the jury trial, which was supposed to begin on September 22nd.
Downs will still be in court that day, as he is due for a scheduling conference. He was arrested in June 2023 after allegedly stabbing an individual with a butcher knife and kicking them while they were on the ground.
The victim survived the attack, but Downs was arrested and charged with Attempted 1st Degree Intentional Homicide, Substantial Battery – Intending Bodily Harm, and Battery, each with Domestic Abuse enhancers, as well as Resisting or Obstructing an Officer.
His scheduling conference will begin at 8:30 a.m.
