Following turnover, a new judge and court date have been set for a lawsuit against the City of Sheboygan.
Court records show that Judge Samantha Bastil is now presiding over the lawsuit filed by eight residents in regard to a proposed Kohler golf course in the Black River area of the city.
Bastil takes over the case after The City, the defendants, filed a request to substitute Judge Rebecca Persick.
Following Persick, Judges George Limbeck and Angela Sutkiewicz were selected before Judge Bastil was finally picked to preside over the case.
Following the selection of a new judge, the case will resume proceedings on June 9th with a scheduling conference.
In the lawsuit, the residents claim various forms of wrongdoing by the city including going against its own municipal code, conflict of interests, and ignoring a decision by the Wisconsin Court of Appeals amongst others.
The Sheboygan residents’ argument revolves heavily around a November 12th Plan Commission meeting where an extension was given to Kohler for their Conditional Use Permit for the land where the proposed golf course would be built.
This extension came over 1,000 days after the City’s own requirements which state, “The start of construction of any and all conditional uses shall be initiated within 365 days of their approval by plan commission.”
