A Green Bay man previously convicted in a 2023 murder case is trying to change his plea ahead of his sentencing.
Court documents show that 26-year-old Omar Hernandez was in court on Monday (February 24th) for a scheduled sentencing hearing after being found guilty due to no contest pleas to charges of First-Degree Reckless Homicide and First-Degree Reckless Injury.
However, FOX11 reports that not only was Hernandez not sentenced on Monday, but he also expressed a desire to withdraw the no contest plea.
The 26-year-old’s attorney was unavailable for the sentencing hearing, and while discussing future dates for a new sentencing hearing, Hernandez made his desire known to change his plea in the case.
Omar and his brother, Jose Hernandez, were both convicted after entering pleas last year ahead of their scheduled trial dates.
According to a criminal complaint, Green Bay Police responded to Clayton Place on a report of shots fired on February 11th, 2023.
Officers found one person, Edgar Rodriguez-Hernandez, who was deceased with massive head trauma while another individual was hospitalized with three gunshot wounds to his chest.
It is believed that the dispute between the Hernandez brothers and Rodriguez-Hernandez and the unnamed individual stemmed from a bar fight earlier in the night.
Omar is scheduled to return to court on April 21st for his sentencing hearing, however, the withdrawal of his no contest plea could be discussed instead.
