
Officer James Simon of the Watertown Police Department will not face charges in connection with the October shooting that resulted in the death of 30-year-old Justin Whitten.
The Jefferson County District Attorney’s Office has decided not to pursue criminal prosecution, citing Officer Simon’s claim that he shot Whitten after the suspect brandished and armed a pistol while attempting to evade the police on a skateboard.
Witnesses reported that police personnel provided initial aid to Whitten, who was later pronounced dead at the scene.
