The trial for a Green Bay teenager accused of starting a housefire that claimed the life of her infant nephew has been declared a mistrial.
A jury deliberated for over six hours but could not come to a unanimous decision in the case of Marcelia Fonseca, leading Judge John Zakowski to declare a mistrial.
The 19-year-old Fonseca remains in the custody of the Brown County Sheriff’s Office, with a status hearing scheduled for December 12th.
One of the main sticking points it seems was the actual cause of the fire.
According to WBAY court reporter Brittany Schmidt, the state’s investigator report pointed to evidence that the origin was in a metal basket in a bedroom, but a fire investigator called to testify said that it is possible that a TV in that same area could be to blame.
