
One of the three people charged in the 2018 death of a Manitowoc County child is continuing to push for an appeal.
Damian Hauschultz was convicted in the death of his 7-year-old cousin Ethan after he forced the young child to carry a log around a yard and buried him in the snow.
Damian was 14 at the time, but now, at 19 years old, his defense team claims that his Miranda Rights were violated.
The defense team submitted a 17-page argument that also claims that due to the imbalance of Damian’s vulnerability in the interrogation room and the tactics used by the police render his confessions involuntary.
His father, Timothy Hauschultz is awaiting trial pending the outcome of this appeal, while his mother Tina McKeever Hauschultz, is currently in prison serving a five-year sentence.
