
The state Court of Appeals has upheld the conviction of a 32-year-old man charged with his son’s death.
Cory Lyons was found guilty previously on a charge of First Degree Reckless Homicide after his seven-week-old son died in 2018.
While being interviewed by police shortly after the incident, Lyons admitted to shaking the young boy because he was getting irritated by his crying.
The shake was enough that the child suffered brain injuries, which an autopsy determined was the cause of death.
Lyons and his defense team argued that the statements he made shortly after his son’s death should not have been admissible in court, but the court disagreed.
Lyons was sentenced to 20 years in prison.
