One of the two people charged in a Kaukauna homicide says she shouldn’t be held responsible.
Tanya Stammer is telling the court that she was a coerced victim of human trafficking, and thus should not be found guilty for her role in the death of Brian Porsche last year.
This is the first time someone in this area has used what is known as an affirmative defense since the Wisconsin Supreme Court ruled on it in July.
The ruling states that victims of human trafficking cannot be held liable for “offenses committed as a direct result of being trafficked”, and this includes homicide.
Her defense team has also stated that they will be providing evidence to the court showing that was indeed the case.
Stammer’s trial is scheduled to begin in July, while the other suspect, Dontae Payne, will be back in court on February 3rd.
