
One of the three people charged following the death of 7-year-old Ethan Hauschultz in April of 2018 is still awaiting his trial, but it is still a way out.
Ethan’s Uncle Timothy Hauschultz and his defense looked to have his case dismissed until Damian Hauschultz’s appeal process is complete, and they say Timothy’s Constitutional Rights are being infringed.
Judge Jerilyn Dietz recently disagreed and denied the motion.
Timothy is accused of ordering Damian to punish Ethan by forcing him to carry a 44-pound log around the yard and bury him in the snow.
Timothy has been sitting in jail since February of 2019 as he has been unable to post his now $75,000 bond.
His trial is not likely to start until early next year, at the absolute earliest.
