
A Manitowoc man has been sentenced to probation and jail time for causing the traffic death of a Mishicot man almost 3-years ago.
Court records in Sheboygan County indicate that 20-year old David Benishek was on his phone and returning home from a graduation dinner in May of 2019, when his vehicle struck the trailer of a truck being driven by 38-year old Dean Collard, Senior.
Collard was ejected as the truck rolled and he died at the scene along I-43 in the Town of Mosel.
Benishek was ordered by Sheboygan County Circuit Judge Kent Hoffmann to 5-years on probation, with 6-months in jail, payment of restitution, and 250 hours of community service.
A jury found the local man guilty of homicide by negligent operation of a vehicle last October based on evidence including phone and car data. Benishek, who is now a student at UW-Whitewater, will serve his time behind bars in separate 3-month periods over the next 2-summers with school and work release arrangements.
