The Wisconsin Supreme Court has declined a request to take up a challenge of the mask mandate in Dane County.
Friday’s vote was 4-3 as the high court decided not to exercise its own jurisdiction.
Lower courts in Wisconsin will have to consider any legal challenges to the public health order first.
Under the order being questioned, everyone who is older than two years old has to wear a face-covering when they are in an enclosed space that is open to the public.
The Wisconsin Institute for Law and Liberty had asked the justices to hear its lawsuit.
