The Manitowoc man accused of breaking into someone’s home and attacking them has returned to court.
29-year-old Emahd Brown-Payne was present for his preliminary hearing this past Thursday (October 15th), as he has been charged with Burglary, Strangulation or Suffocation, and Disorderly Conduct, all of which carry repeater modifiers.
During that hearing, it was revealed that Brown-Payne qualifies for legal representation through the Public Defender program; however, they have been unable to find him a lawyer.
For this reason, Judge Robert Dewane halted proceedings to allow the 29-year-old to find legal counsel.
Brown-Payne is alleged to have broken the window of a Manitowoc residence to gain access to the home.
Once inside, he strangled the victim, leaving visible injuries to her neck, broke her phone, and destroyed objects on the front porch as well.
He will now return to court for his rescheduled preliminary hearing on October 29th.
