The prosecution and defense teams in the Timothy Hauschultz criminal case were back in court yesterday for their pre-trial conference.
Hauschultz is the final defendant in the death of Ethan Hauschultz, the 7-year-old Newton boy who died while serving a punishment at his great-uncle’s home in 2018.
Timothy is accused of ordering the punishment, which included carrying a heavy log around the yard, while Damian Hauschultz was convicted for his role in carrying out the punishment.
Timothy’s defense team claims Damian acted of his own accord.
During the pre-trial conference, both sides agreed to let Timothy’s CCAP record be sealed, and it was ordered that Damian and his attorney be present for his testimony.
When the jury is selected, each side will have six available strikes, meaning they can remove up to six jurors from the panel.
Fourteen jurors will be selected along with two alternates.
The two-week-long trial is set to begin on October 12th, in front of Calumet County Judge Carey Reed.
