A new judge has been selected to handle the Damian Hauschultz case.
After Judge Jerilyn Dietz was forced to recuse herself from the case, Judge Robert Dewane was chosen to handle a hearing for post-conviction relief filed by Hauschultz and his lawyer.
He was convicted on a charge of 1st Degree Reckless Homicide for the 2019 death of 7-year-old Ethan Hauschultz, however, it was learned that Judge Dietz had served as a Guardian ad Litem for him in a family court proceeding in 2017.
Dewane is no stranger to Hauschultz either, as he actually presided over that case.
In his latest motion, Hauschultz claims that he should not have been charged with 1st-degree reckless homicide because his lawyer at the time was ineffective in arguing for him.
So, he is asking for a new trial or to be resentenced.
Ethan died after Damian forced him to carry a heavy log around their backyard and buried him in the snow, a punishment allegedly ordered by Ethan’s uncle, Timmothy Hauschultz.
Timothy’s case is currently set to go to trial on February 23rd, with Judge Carey Reed presiding.
