A Francis Creek man facing both federal and civil sexual assault charges wants to limit information about himself coming out before a trial.
Court records show that 76-year-old Michael Kornely was back in Manitowoc County court yesterday for a motion hearing, talking about rape shield evidence being introduced.
Judge Mark Rohrer stated that the defense must file a more detailed brief outlining what the defendant would attest to, and that if he rules in favor of Kornely, the defendant will have to testify.
Kornely’s attorney was given until February 5th to file a supplemental brief before the state would respond.
Judge Rohrer set the next court date for May 11th, when he will make a decision.
Kornely was first charged after Manitowoc County Sheriff’s say he sexually assaulted someone and tried to meet another minor for sex online.
He’s currently facing charges of 2nd-degree sexual assault and 3rd-degree sexual assault.
However, a federal court later charged him with transporting two minors across state lines with the “intent to engage in criminal sexual activity” in 2005 and 2006.”
The 76-year-old will face a minimum of 10 years in prison for each guilty verdict and would be required to register as a sex offender for his federal case.
