
The man charged in the death of Ethan Hauschultz will have a motion hearing today.
Court records show that 55-year-old Timothy Hauschultz will be back in court this morning (December 11th) before he’s scheduled to go to trial in January.
Timothy is facing charges including felony murder, intentional contribution to delinquency causing death, and three counts of child abuse, intentionally causing harm.
Prosecutors and the defense for Timothy brought two plea deals, but both judges who’ve presided over the case have rejected them, saying they were not in the public’s best interest.
A criminal complaint says Ethan died because he was forced to carry a log for not knowing Bible verses, and Timothy allegedly ordered the punishment.
However, the 55-year-old could not go to trial because he could have been called as a witness in the case against 22-year-old Damian Hauschultz.
Damian was charged with Ethan’s death after he hit and pocked the 7-year-old over 100 times before burying him in the snow.
The 22-year-old is serving a 20-year prison sentence after taking a plea deal for 1st-degree reckless homicide.
Timothy also had to wait until Damian’s appeals made their way through the court system before his case could move forward.
