The man who formerly worked as the Outagamie County HR Director, now charged with child pornography possession, wants to withdraw his guilty plea.
WBAY reports that 36-year-old Adam Westbrook pleaded guilty to one count of distributing child sex abuse material and is facing up to 8 to 12 years behind bars.
However, in a new court document filed in October, Westbrook is asking to withdraw his guilty plea, arguing that he had ineffective counsel and that his lawyer at the time didn’t obtain key evidence and failed to fulfill his request to review it before taking the plea.
The document also says the 36-year-old’s former attorney told him there wasn’t enough time to review the evidence and that an Alford plea wasn’t available.
Westbrook now argues that he should have gone to trial for the charges he faces because the “images in the case weren’t intended to capture sexually explicit conduct.”
He also says he pleaded under pressure from his attorney. Federal attorneys have until November 17th to respond.
Westbrook was arrested last year after police said he recorded and shared sexually explicit videos of a child in a Sauk County hotel.
The incident led to the indictment of two other people.
Westbrook also served as the former HR Director for the City of Sheboygan and Outagamie County before his arrest.
