The man accused of fatally shooting someone in Downtown Sheboygan Falls last month is heading to trial.
36-year-old Luis E. Cruz Burgos was in Sheboygan County court yesterday (October 29th) for his preliminary hearing as he faces one count of First-Degree Reckless Homicide.
During the hearing, District Attorney Joel Urmanski called Officer Oetzel with Sheboygan Falls PD to the stand as he was the first to respond to the 600 block of Monroe Street, the location where Canadian, 32-year-old Giovanni Michael Robisnon was fatally shot on September 24th.
During his testimony, he explained what he saw on the scene, during witness interviews, and during his interviews with Cruz Burgos that ultimately led to the 36-year-old’s arrest in connection to the shooting.
He stated that GPS tracking data and surveillance camera footage placed Cruz Burgos in Downtown Sheboygan Falls in the moments leading up to the gunshot that would ultimately take Robinson’s life.
While defense attorney LaCombe argued that no firearm was ever located in the vehicle or residence of Cruz Burgos, nor were any bullet casings found on the scene, an autopsy confirmed that the 32-year-old’s cause of death was a gunshot wound to the chest, which struck multiple organs.
For this, along with Officer Oetzel’s testimony, Judge Natasha Torry found probable cause in the case and had Cruz Burgos bound over for trial.
He will now return to court on November 17th at 4:00 p.m. for his arraignment.
