
Prosecutors are looking to change a charge for the man suspected in the death of Ethan Hauschultz.
FOX11 reports that District Attorney Jacalyn LeBre submitted a motion to amend information to replace count one of felony murder to child neglect, death as a consequence.
According to the motion, the chance would still support the charges Timothy Hauschultz is facing while allowing the defense to prepare four months before the case is set to go to trial next year.
If convicted, Timothy could face up to 25 years in prison. Defense Attorney Donna Kuchler has not responded to the motion yet.
Timothy was arrested in 2019 after the 8-year-old Ethan died as a result of a punishment for not knowing Bible verses.
Timothy had Damian Hauschultz oversee the punishment where Ethan was hit and poked over 100 times before his body was buried in the snow.
Ethan would later pass away from his injuries.
Damian has since been convicted of 1st-degree reckless homicide in Ethan’s death and is serving a 20-year prison sentence.
Timothy was supposed to plead guilty earlier this year to two counts of child neglect, but Judge Jerilyn Dietz did not accept the plea deal, saying it is not in the best interest of the public.
She has since had to dismiss herself from the case.
