A Manitowoc man charged in a recent homicide will be bound over for trial.
20-year-old Kirk Dunn was back in Manitowoc County court earlier today (October 9th) for his preliminary hearing, during which he also tried to get a charge of 2nd-degree recklessly endangering safety dropped.
Attorney Mellisa Barrette claimed that where the victim was located at the time would not have created a reason for death or great bodily harm.
According to District Attorney Jacalyn Lebre, the victim was sleeping on a couch when a gunshot came through a door of the residence he was staying at.
Judge Anthony Lambrecht denied the motion saying that Dunn should have realized that firing multiple rounds could have caused someone to be hit in the area.
During the preliminary hearing, Detective Eric Schultz testified that the homicide victim, identified by family as Jasiah Owens, was found outside of a private vehicle near 17th Street that a witness was driving.
Schultz said the witness told him that the two were supposed to meet to help a woman at an apartment complex on Dewey Street.
When they arrived, the witness says Owens talked got out a car and talked to a woman.
He then went to “manipulate a door” and started walking back.
The witness then said they suddenly heard lots of gunshots and saw the victim fall to the ground.
Schultz explained that Dunn told him he (Dunn) walked out of his apartment and saw a blue laser on his chest.
The 20-year-old claimed he heard a shot first and returned fire and went back inside the apartment.
Owens was hit three times, twice around the abdomen and once in the leg and died from his injuries.
Attorney Barrette questioned Schultz about the relationship between the victim and the girlfriend of Dunn and that Owens and that they both had previous altercations before the homicide.
During closing statements, Barrette argued that Owens was the one who wanted to hurt Dunn.
Lebre said Dunn purposely dressed in all black clothing and a black mask and shot and killed Owens.
Judge Lambrecht found the state met their burden of proof and set an arraignment date for October 15th.
