Attorneys are still deciding whether two men charged in a Green Bay homicide could be allowed to stand trial together.
FOX11 reports that 41-year-old Christian Rivera-Pica and 40-year-old Joel Pagan-Garcia were back in a Brown County Courtroom yesterday (October 6th) as they face charges in the murder of Carlos Otero-Aviles on the city’s west side.
Both defendants are sharing the same attorney, which is not usually the case because they both could have different evidence used against them.
However, Rivera-Pica and Pagan-Garcia waived a conflict of interest, allowing the same attorney to represent them both.
Defense attorneys have also requested that the two men stand trial together.
Prosecutors, however, argue that some evidence has yet to be returned, which could necessitate separate trials.
The 41-year-old and 40-year-old suspects were arrested earlier this year, but the homicide of Otero-Aviles happened in November 2023 on the 1700 block of Western Avenue.
Green Bay Police called on a report of shots fired, and when they arrived, they found Otero-Aviles had been shot in the parking lot of an apartment complex while attending a child’s birthday party.
Both suspects are scheduled to return to court on November 5th.
