
It appears that the City of Sheboygan will be able to move forward with constructing another golf course on the shores of Lake Michigan.
Court documents show that Judge Samantha Bastil has thrown out the lawsuit filed by eight residents against the City’s Plan Commission and Zoning Board of Appeals regarding a proposed Kohler golf course.
During the oral ruling in the case held on Friday (September 12th), Judge Bastil granted the City’s motion to dismiss the civil suit because the petitioners had a lack of standing, and the issues were moot.
The ruling continued to explain, “Petitioners did not properly request an appeal within the mandatory 30-day requirement in Chapter 68, and the BOA does not have the authority to hear a planning commissioners appeal.”
The residents filing the lawsuit all live in the Black River community, the site of the proposed golf course that the Kohler Company is hoping to build.
At this time, the future of the project remains somewhat unclear, but it does appear to be moving forward again.
