
The City of Sheboygan is attempting to get a lawsuit thrown out.
Legal records show that the court has received a brief from the legal counsel representing the City’s Plan Commission and Zoning Board of Appeals that is in support of dismissing the lawsuit filed by residents who are opposed to the building of a proposed Kohler golf course.
This lawsuit has been filed by eight residents living in the Black River area of the city, the proposed location where the Kohler Company and the City are hoping to construct a golf course.
If built, this would become the third Kohler-owned golf course in Sheboygan County.
The lawsuit filed against the city claims many different forms of wrongdoing, much of which stems from a Plan Commission meeting last year where an extension was given to Kohler for a conditional use permit on the land.
Other aspects include the City going against its own municipal code, conflicts of interest, and ignoring a decision by the Wisconsin Court of Appeals.
This extension given out by the Plan Commission came more than 1,000 days after the City’s deadline to do so as laid out in the Sheboygan municipal code.
The eight plaintiffs and their lawyers will now have 30 days to respond to the motion to dismiss.
This case will next go in front of Judge Samantha Bastil on September 12th for an oral ruling.
