
The trial for the great-uncle charged in the death of Ethan Hauschultz has been set again.
According to court records, 55-year-old Timothy Hauschultz was back in a Manitowoc County Courtroom last Friday (July 11th) because both prosecutors and the defense are discussing what the recusal of Manitowoc County Judge Jerilyn Dietz means for the case.
Calumet County Judge Carey Reed suggested a jury trial date, with the trial lasting around two weeks.
Both parties have been asked to submit a timeline to the court by the end of August, with the first day of jury trial set for February 2nd.
Timothy will return to court in November for a review hearing.
Timothy was scheduled to go to trial at the beginning of this year, but prosecutors and the defense had come up with a plea deal, which would have had him plead no contest to two charges of child abuse.
However, when Judge Dietz was still presiding, she ruled against the deal, saying it wasn’t in the public’s best interest.
She recused herself from the case after she found out she would advocate for a child who couldn’t represent themselves, causing a conflict of interest.
Timothy has been charged with felony murder in the death of Ethan back in 2018.
Prosecutors allege that he was the person who forced Ethan and his cousin, Damian Hauschultz, to carry a heavy log outside for not knowing Bible verses, which led to Ethan’s death.
Damian is serving a 20-year prison sentence for Ethan’s death after he was poked and hit over 100 times and later buried in the snow.
He would later die in a hospital from his injuries. Timothy couldn’t go to trial previously because Damian had to go through the appeals process since he could be a witness in Timothy’s case.
