
The next steps are coming in the lawsuit against Sheboygan regarding a proposed Kohler golf course.
Court records show that there is a scheduling conference set for today (June 9th) in the lawsuit filed by eight Sheboygan residents against the City of Sheboygan’s Plan Commission and Zoning Board of Appeals.
These eight residents all live in the Black River area of Sheboygan, in close proximity to the proposed location for a golf course that the Kohler Company is hoping to build on the shores of Lake Michigan.
In the lawsuit, the residents claim various forms of wrongdoing by the city, including going against its own municipal code, conflict of interests, and ignoring a decision by the Wisconsin Court of Appeals, among others.
The Sheboygan residents’ argument revolves heavily around a November 12th Plan Commission meeting where an extension was given to Kohler for their Conditional Use Permit for the land where the proposed golf course would be built.
This extension came over 1,000 days after the deadline, and the City’s own requirements state, “The start of construction of any and all conditional uses shall be initiated within 365 days of their approval bythe plan commission.”
Additionally, Wisconsin Circuit Court Access also shows that the residents’ complaint was amended on Wednesday (June 4th), however, it is uncertain what changes have been made at this point.
