The man convicted in the fatal shooting at the Fox River Mall is no longer looking to withdraw his plea.
Court records show that the lawyer for 21-year-old Dezman V. Ellis has rescinded a previous motion to withdraw his no-contest pleas, which was initially filed in December of last year.
Ellis was convicted of Second-Degree Intentional Homicide and First-Degree Recklessly Endangering Safety in November of 2021 for fatally shooting Jovanni Frausto during an argument and for injuring a bystander with a stray round at the Fox River Mall on January 31st, 2021.
Ellis would flee the scene and later be apprehended by authorities in Iowa.
No reason was given for no longer pursuing a plea withdrawal, as the 21-year-old is serving 40 years in prison after a plea deal was reached in 2021.
