
More details have emerged regarding the lawsuit filed mentioning the former Sheboygan Chief of Police.
In a follow-up report, the Sheboygan Common Council discussed retaining legal counsel in the case Markell Nathaniel Mitchell v. Christopher Domagalski, the recently retired Police Chief, during their Monday meeting (May 19th).
In reality, the lawsuit filed in the U.S. District Court Eastern District of Wisconsin is entitled Markell Nathaniel Mitchell v. Sheboygan County, Nathan F. Haberman, Grant D. Scaife, Jeffrey A Jaeger, Joseph Serge, Alexander Huber, John Doe Officers, John Doe Supervisor, and the City of Sheboygan.
The lawsuit does not implicate or accuse Chief Domagalski of any wrongdoing, however, he has been named as a temporary defendant for the sole purpose of helping Mitchell and his legal counsel confirm the names of the John Doe Officers and Supervisor from the Sheboygan Police Department.
The lawsuit alleges that a man called the police, stating that two individuals were holding him at gunpoint.
Once officers arrived, the ones referred to as John Doe, they disregarded his claims and arrested him for theft of a firearm despite not being in possession of any firearm, let alone a stolen one.
The suit further explains that there was no probable cause for Mitchell’s arrest, and he was later subject to physical abuse while at the Sheboygan County Jail.
He was in custody for 10 months as his case was allegedly intentionally dragged out to accept a plea deal.
However, Mitchell feels that his detention was unjust as he would later be acquitted of all charges against him in the case, and thus why he has filed the lawsuit.
The court has dismissed the defendants Sheboygan County, Haberman, Scaife, Jaeger, Serge, Huber, and the City of Sheboygan from the case, and Chief Domagalski will be removed from the lawsuit entirely after supplying the implicated identities.
