The adoptive father charged in the death of Ethan Hauschultz is looking to get a jury from outside of Manitowoc County.
Court records show that a motion was made last Friday (April 25th) for a jury pool change for Timothy Hauschultz.
Timothy was back in court yesterday (April 28th) for a scheduling conference.
He’s not scheduled to be back in court until September.
Prosecutors have not responded to the request.
Timothy was supposed to accept a plea deal in February that would have had him plead guilty to two counts of child abuse and drop charges including felony murder and two counts of contributing to the delinquency of a child causing death.
Judge Jerilyn Dietz refused to accept the deal, saying it wasn’t in the public’s best interest.
Timothy is facing charges after Ethan died after being forced to carry a heavy log around for not knowing Bible verses.
Damian Hauschultz is serving a 20-year prison sentence for the reckless homicide of Ethan after being convicted of poking and hitting the 7-year-old multiple times, which led to his death.
Timothy’s trial was not able to move forward until appeals from Damian went through the courts, since Damian could be a witness.
