
A new trial date could be set today (February 5th) for the great-uncle charged in the 2018 death of Ethan Hauschultz.
54-year-old Timothy Hauschultz is scheduled to be back in court later this morning for a scheduling conference.
This comes after Judge Jerilyn Dietz agreed to stay the trial after a contentious motion hearing at the end of February.
The defense team for Timothy is asking for Dietz to recuse herself, claiming she has bias in the case.
The appeal has been given to the Wisconsin Court of Appeals and is pending.
This comes after she also ruled that a plea deal reached between prosecutors and the defense wasn’t in the public’s best interest.
Dietz warned with the stay that the trial will be pushed back some time.
Timothy is facing charges including felony murder and intentionally causing the delinquency to a death.
Ethan was poked and hit over 100 times before he was buried in snow and later died at a hospital.
Damian Hauschultz is serving a 20-year prison sentence in Ethan’s death.
Prosecutors say Timothy ordered Damian and Ethan to carry heavy logs, which led to Ethan’s death.
