
Residents have filed a lawsuit against the City of Sheboygan Plan Commission and Zoning Board of Appeals.
The lawsuit, filed on January 31st in Sheboygan County Circuit Court, pertains to the proposed golf course the Kohler Company is attempting to build in the Black River area of the city on the shores of Lake Michigan.
The lawsuit, filed by eight Sheboygan residents living within one mile of the location, cites numerous grievances with the city which include but are not limited to the Plan Commission’s November 12th extension of Kohler’s conditional use permit (CUP) to the land, the CUP not being in compliance with state and city ordinances, and the Wisconsin Court of Appeals upholding the denial of Kohler’s wetland-fill permit from the DNR.
Other topics in the lawsuit include Roger Miller, one of the plaintiffs, being denied an appeal to the November 12th decision by the Zoning Board of Appeals, and Belle Ragins, also a plaintiff, being denied the opportunity to participate in the November 12th public comment portion of the hearing.
Another item noted in the lawsuit involves a conflict of interest in that November 12th vote by Alder John Belanger, who is a Kohler employee but did not recuse himself from the decision involving his employer’s CUP.
