
The trial for Timmothy Hauschultz has been delayed.
Judge Jerilyn Dietz agreed to delay the trial as both the prosecution and the defense had issues with their motions, including the denial of a plea deal.
Both sides started the day in court by asking Judge Dietz to reconsider her denial of the plea, which would have Timothy only charged with Child Abuse in the 2018 death of Ethan Hauschultz, and the dropping of charges including Felony Murder, and Battery as party to the crime.
The defense also called for Judge Dietz to recuse herself from the case, claiming bias. This led to one of several pauses in the hearing, as Judge Dietz looked over other case studies, as she deliberated staying the trial or pushing forward.
In the end, the judge decided to stay the trial and ordered both sides to return to court on March 5th for a scheduling conference.
This is the latest in a long line of delays for the case, as Timothy had to wait for Damien Hauschultz to expend all of his appeals.
