
The great uncle charged in the death of 7-year-old Ethan Hauschultz will be back in court this morning for a motion hearing.
That was the ruling from Judge Jerilyn Dietz after she said she would not accept a plea deal from prosecutors and the defense last week that would have had 54-year-old Timothy Hauschultz only pled to charges of child abuse intentionally causing harm.
According to court documents, there was a preliminary ruling as to allow social workers to testify in Timothy’s trial.
There was also a request for a response regarding a jury questionnaire that would be given to the jury pool before they are picked.
Timothy’s trial would then start tomorrow (February 25th).
He’s facing a felony murder charge in the 2018 death of Ethan after he was found unconscious and buried in snow.
Ethan later died at a hospital from hypothermia and blunt-force trauma.
The defense for Timonthy is arguing that he didn’t have anything to do with the death, but rather just ordered Ethan and Damian Hauschultz to carry heavy logs as punishment.
Damien is serving a 20-year prison sentence after he pleaded no contest to 1st-degree reckless homicide in Ethan’s death in 2021.
