
It was another interesting day in Manitowoc County Court. Timothy Hauschultz was in court for a motion hearing in his felony murder case.
Hauschultz is facing charges related to the 2018 death of 7-year-old Ethan Hauschultz.
The prosecution and defense teams asked Judge Jerilyn Dietz to reconsider the plea deal brought forth last week, which called for Timothy to only be charged with Child Abuse -Intentionally Causing Harm.
District Attorney Jacalyn LaBre called in the best route moving forward in this case, but Judge Dietz denied the request.
In response, Timothy’s defense team asked for Judge Dietz to recuse herself from the case, on the grounds that she had already predetermined the outcome of the trial.
That request was also denied.
As of 10:30 this morning, the court was in recess, to discuss a motion to delay the trial while the recusal motion goes to the state.
Timothy is facing numerous charges in Ethan’s death, which was caused by a punishment Timothy allegedly told Damien Hauschultz to administer to the child.
Damien, who was 17 at the time, forced Ethan to carry a heavy log around the yard, and buried him in the snow.
