The defense and prosecution conferred to come up with new terms, but instead, the defense tried to change Judge Dietz’s mind, but she stood her ground.
A motion hearing was scheduled for Monday at 10:00 a.m., and Timothy’s trial will commence on Tuesday.
***Initial Report***
Big news coming from the Manitowoc County Courthouse as Judge Jerilyn Dietz has denied a plea deal in the Timothy Hauschultz case.
The deal, as reported by District Attorney Jacalyn Labre, was to only charge Hauschultz with two counts of Child Abuse -Intentionally Causing Harm in the 2018 death of 7-year-old Ethan Hauschultz.
Timothy’s lawyer, Donna Kuchler claimed that her client was responsible for the work Ethan was doing, including carrying a heavy log around their property, but not the actions that resulted in his death.
Judge Dietz said she was “not comfortable” with the deal, and gave both sides some time to work out a new deal.
Steven Devine is at the courthouse and will have more on the case once it becomes available.
