
The great-uncle charged in the death of Ethan Hauschultz will have a pre-trial hearing after his case has been on hold for years.
According to court records, 54-year-old Timothy Hauschultz will be in a Manitowoc County Courtroom Friday (February 7th) for the hearing.
Timothy’s case has been on hold after a judge ruled that he can’t go to trial until Damian Hauschultz, Timothy’s nephew, gets his appeals in his conviction moved through the court system.
Court records show that Damien pleaded guilty in 2021 to 1st-degree Reckless Homicide and was sentenced to 20 years in prison for Ethan’s death.
However, since he could be a witness in Timothy’s case, a judge ruled that Damien’s appeals would have to go through the court system.
Damian tried to appeal to the Wisconsin Supreme Court, claiming that his confessions weren’t voluntary because of actions used by police.
The appeals court ruled that the police were okay with their actions and that the Wisconsin Supreme Court didn’t hear the case.
Timothy Hauschultz could be going to trial later this month following his pre-trial conference.
He’s facing numerous charges, including felony murder, three counts of intentionally causing delinquency, and two counts of battery as a party to a crime.
Ethan died after he was forced to carry a heavy piece of wood because he didn’t learn Bible verses.
He was later buried in the snow as punishment.
He died from blunt force trauma and hypothermia, according to a medical examiner.
