The Wisconsin Supreme Court will decide whether to hear arguments of an appeal in the Ethan Hauschultz case.
20-year-old Damien Hauschultz pleaded guilty to 1st-degree reckless homicide and was sentenced to 20 years in prison for the death of the 7-year-old in 2018.
Two months ago, his appeal to an appellate court was denied when the court ruled, he made voluntary statements to police officers when questioned.
According to FOX11, Damien has now appealed to the Supreme Court, which had to decide if they want to hear the case and if they do, they will schedule oral arguments.
With this change, the trial for Ethan’s great-uncle Timothy Hauschultz has again been put on hold indefinitely until the Supreme Court decides if they’ll take Damien’s case.
Ethan died of hypothermia and blunt force trauma after being forced to carry a very heavy log around as punishment for not knowing Bible verses to Timothy’s satisfaction.
Damien was supervising the punishment and was found to have poked or hit Ethan with a stick while carrying the log.
Timothy’s wife, Tina McKeever-Hauschultz, served five years in prison for her role and has been released on extended supervision.
