The Wisconsin Supreme Court has upheld a lower court decision affirming certain Amazon gig workers as employees.
In a unanimous verdict, the court’s ruling holds Amazon accountable for approximately $200,000 in additional payroll taxes within the state.
The decision stems from a prior appellate court ruling classifying the company’s “delivery partners” as employees, entitling them to minimum wage, overtime compensation, and unemployment insurance benefits.
Amazon contends that its delivery partners are independent contractors, akin to the work models of DoorDash or Instacart, responsible for delivering packages using their vehicles and a smartphone app.
