
The man accused of abusing missing 3-year-old Elijah Vue has filed a motion to dismiss the charges against him.
The motion, which was acquired by FOX11, was filed by Jesse Vang and his attorney, Timothy E. Hogan, out of Appleton, and claims the Neglecting a Child charge against him is not specific enough.
Hogan claims that the abuse defined in the criminal complaint was not a “failure to provide necessary care” and that the complaint “fails to provide sufficient notice to Mr. Vang as to the alleged neglectful action that would allow him to plead and prepare a defense.”
The motion asks that prosecutors either make the charge more definite or dismiss it altogether.
As of this morning, the only scheduled court date for Vang is still his preliminary hearing, which is scheduled for this Thursday.
No response has been given in regard to the motion by either the prosecution or the court.
